JUDGMENT; IT IS ORDERED AND ADJUDGED that the bankruptcy courts order dated August 6, 2008 is VACATED and SunTrust is restored to its pre-petition status in all respects except as to the sum of funds advanced by Capital Bank (and interest accruing th ereon) prior to this courts November 19, 2008 oral order allowing SunTrusts Motion to Stay pending appeal. 11 U.S.C. section 364(e).
