This action came before the Honorable Louise W. Flanagan, Chief United States District Judge, for consideration of the plaintiff's motion to dismiss and remand and defendant's motion for preliminary injunction. IT IS ORDERED, ADJUDGED AND DECREED in accordance with the court's order entered September 28, 2010, and for the reasons set forth more specifically therein, that the plaintiff's motion to remand is granted where the matter does not raise a question of federal law and jurisdiction is not proper under any of the removal statutes cited by defendant. This case is hereby remanded to the Harnett County Superior court. Based on the court's decision to remand this matter to the North Carolina state court, defendant's motion for preliminary injunction is denied as moot.
