ORDER
On February 1, 2021, Kenneth Frierson ("Frierson" or ''plaintiff'') filed a complaint against
The Shaw University ("Shaw'' or "defendant'') alleging wrongful employment termination under
Title IX of the Education Amendment Act of 1972, 20 U.S.C. § 1681(a) ("Title IX'') [D.E. 1]. On
July 20, 2021, Frierson filed an amended complaint [D.E. 11]. On August 29, 2022, Shaw moved
for summary judgment [D.E. 26] and filed a memorandum in support [D.E. 27], exhibits [D.E. 28],
and a statement ofmaterial facts [D.E. 29]. On August 30, 2022, Shaw filed an amended motion for
summary judgment [D.E. 32]. On September 21, 2022, Frierson responded [D.E. 36] and filed an
opposing statement of material facts [D.E. 37]. On October S, 2022 Shaw replied [D.E. 42]. The
