Defendants Duke University, Robert K. Steel, Richard Brodhead, John Burness,
Matthew Drummond and Victor J. Dzau (hereinafter “Duke University Defendants”), and
Aaron Graves, Robert Dean, and Gary N. Smith (hereinafter “Duke University Police
Defendants”) presently are represented in this action by J. Donald Cowan, Jr. of the law
firm of Ellis & Winters LLP. On 29 May 2011, Mr. Cowan suffered a medical event. As
a result, Mr. Cowan is unable to participate at this time in the representation of the Duke
University Defendants and the Duke University Police Defendants. The Duke University
Defendants and the Duke University Police Defendants continue to be represented in this
action by Richard W. Ellis and Dixie T. Wells of the law firm of Ellis & Winters LLP.
