IN THE UNITED STATES DISTRICT COURT FOR THE MIDDLE DISTRICT OF NORTH CAROLINA CIVIL ACTION NUMBER 1:07-CV-00953 RYAN McFADYEN, et al., ) ) Plaintiffs, ) ) v. ) ) DUKE UNIVERSITY, et al., ) ) Defendants. ) ) ______________________________ ) JOINDER MOTION TO JOIN DUKE DEFENDANT’S MOTION DOCUMENT 338 IN OPPOSITION TO PLAINTIFF’S MOTION TO STAY MOTION FOR JUDGEMENT ON THE PLEADINGS [DE 337] AND PLAINTIFF’S MOTION [DE 327] FILED AS TO DEFENDANT WILSON For reasons therein stated in Duke Defendant’s motion 338, in opposition to Plaintiff’s Motion to Stay Motion For Judgment on Pleadings [DE 337], Defendant Linwood Wilson files this Motion of Joinder with Duke Defendant’s Motion 338. Defendant Wilson has previously filed Motions 330 in response to Plaintiff’s Motion 327. However, since the filing of Plaintiff’s Motion 327, Plaintiffs filed for an extension of time to File a petition for a writ of certiorari with the United States Supreme Court since the Fourth Circuit denied an en blanc hearing for the Plaintiffs. CONCLUSION For the foregoing reasons, that the Duke Defendants respectfully request that the Court enter an Order denying the stay of proceedings sought in Plaintiffs’ Motion to Stay Proceedings. [DE 337], Defendant Wilson respectfully request the Court, in this Joinder Motion, to deny the stay of proceedings sought in Plaintiff’s Motion to Stay Proceedings [DE 327] as to Defendant Wilson.
