The court therefore adopts the Magistrate Judge’s
Recommendation. 1
IT IS THEREFORE ORDERED that Respondent’s Motion for
Summary Judgment (Doc. 7) be GRANTED and that the petition be
DISMISSED WITH PREJUDICE.
