MEMORANDUM OPINION AND ORDER signed by JUDGE N. C. TILLEY, JR on 03/23/2018, that Defendant Duke University's Motion for Judgment on the Pleadings [Doc. # 67 ] is DENIED IN PART in that this Court finds the parties were served within the tim e allotted and personal jurisdiction is established over each Defendant by the extension of time to serve and GRANTED IN PART in that Plaintiffs' claims for ( 1) Negligence and (2) Wrongful Death are barred by Waiver and Release. FURTHER that Defendant Organization for Tropical Studies' Motion to Dismiss, or in the alternative, For a Judgment on the Pleadings [Doc. # 71 ] is DENIED IN PART in that this Court finds the parties were served within the time allotted and personal ju risdiction is established over each Defendant by the extension of time to serve and GRANTED IN PART in that Plaintiffs' claims for ( 1 ) Negligence and (2) Wrongful Death are barred by Waiver and Release. The Intentional Infliction of Emotional Distress claim against both Defendants remains.(Taylor, Abby)
