[Doc. 18]. THAT WHEREAS it has been made to appear to the undersigned th a t a Complaint was filed and summons issued in this action, and said s u m m o n s , together with a copy of said Complaint, was served on the each o f Defendants; A n d it further appearing that no answer, motion to dismiss, or p le a d in g has been filed by any of the Defendants, that no extension of time to file pleadings has been sought or granted, that the time for pleading or o th e rwis e defending has expired, and that the default of the Defendants h a s been entered according to Rule 55(a) of Federal Rules of Civil P ro c e d u re [Doc. 17]; And it further appearing that the amounts of the requested judgments s o u g h t by the Plaintiff have been provided through the affidavits of Craig A. L e s lie , Esq. and Brad Hartz in support of the Application for Default J u d g m e n t; And it further appearing that pursuant to Rule 55(b)(1) of the Federal R u le s of Civil Procedure and with good cause shown, the Plaintiff is entitled to a default judgment; IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that th e Plaintiff have and recover judgment as follows: (1 ) A g a in s t the Defendants Allen Baker, Ronald Ravenstein a n d Ronald Thomas in the amount of $951,003.89, which in c lu d e s interest, costs, and attorneys' fees through and in c lu d in g December 31, 2009, plus interest at the per -2- d ie m rate of $218.61 from December 31, 2009 to the date o f this Judgment; and (2 ) A g a in s t the defendant Orin Smith in the amount of $ 7 7 ,6 4 7 .7 0 , which includes interest, costs, and attorneys' fe e s through and including December 31, 2009, plus in te re s t at the per diem rate of $19.03 from December 31, 2 0 0 9 to the date of this Judgment.
