Memorandum Opinion and Order For the reasons stated in the Order, Defendant's Motion For Summary Judgment On Plaintiff's Unjust Enrichment and Fraud Claims, and Supporting Memorandum of Points and Authorities (ECF # 75 ) and Defend ant's Motion for Partial Summary Judgment On the Enforceability And Meaning of Settlement Agreement, and Supporting Memorandum of Points and Authority (ECF # 76 ) are GRANTED in part and DENIED in part. Plaintiff Parma Community General Hospita l's Motion for Summary Judgment on Defendant's Counterclaim,(ECF # 72 ), is DENIED. Trial remains set for March 15, 2011 at 8:30 a.m. Trial will address Plaintiff's claim for breach of contract; Defendant's claim for breach of the December settlement agreement; and, Plaintiff's claim of fraudulent inducement (and/or defense of rescission) with regard to the December settlement.
