Memorandum Opinion and Order. The Magistrate Judge's Report and Recommendation is accepted in part and reversed in part. The plaintiffs' motion to certify this matter as a collective action is granted. The plaintiffs' motion for partial summary judgment is granted, as follows: (1) Granted on the issue of Mr. Mehmedi's and the opt-in plaintiffs' status as non-exempt employees; (2) Granted on the issues of a three-year statute of limitations and liquidated damages as to all plaintiffs; (3) Granted on the issue of damages to opt-in plaintiff Michael Thorpe in the amount of $120.00 (related docs 45 , 47 , 56 ).
