Memorandum Opinion: For the reasons stated in the Magistrate Judge's 10 Report and Recommendation, the Petition is barred by the applicable one-year statute of limitations and a reasonable jurist could not conclude that dismissal of the 1 Petition is in error or that Petitioner should be permitted to proceed further.
