Memorandum Opinion and Order. For the reasons set forth above, the Court finds that the uninsured motorist provision of the policy does provide coverage for the accident at issue, but, there is no evidence that Allstate acted in bad faith whe n denying the claim. Accordingly, Defendant, Allstate's Motion for Summary Judgment (ECF # 52 ) is GRANTED in Part, and DENIED in Part, and Plaintiffs' Motion for Partial Summary Judgment is also GRANTED in Part and DENIED in Part. (ECF #[5 1]). Plaintiffs are entitled to coverage under the policy and Defendants are entitled to Summary Judgment on the claim of bad faith. Trail remains set for March 9, 2020 at 8:30 a.m. on the issue of damages. IT IS SO ORDERED. Judge Donald C. Nugent on 1/14/2020. (M,S)
