Judgment Entry: For the reasons stated in the Order filed 6/30/08, ordered that Plaintiffs motions for leave to proceed in forma pauperis, file an affidavit and file a restatement of the case are granted. Defendant's motion for summary judgment is granted. Plaintiff's motions for leave to amend his complaint and refile for a temporary restraining order and for summary judgment are denied. Further, the Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that an appeal from this decision could not be taken in good faith and should not be allowed without prepayment of the requisite appellate filing fee..
