ORDER that MSD is responsible for the damages sustained regarding sewer back-up claim 652 filed by Thomas R. Stahlheber. Mr. Stahlheber's appeal is therefore sustained. In view of this finding, MSD is granted leave to supplement the record with evidence of the fair market value of the items for which Mr. Stahlheber seeks compensation. MSD should attempt to settle the damages claim with Mr. Stahlheber. If the parties are unable to settle the claim for damages, MSD must notify the Court within (60) days, at which time the Court will rule on the damages claim. Signed by Magistrate Judge Karen L.
