Merz ORDER FOR SUPPLEMENTAL BRIEFING This capital habeas corpus case is before the Court on Respondent's Notice of Supplemental Authority (Doc. No. 152) which calls the Court's attention to Cullen v. Pinholster, 563 U.S. ___, 2011 U.S. LEXIS 2616 (Apr. 4, 2011). The Magistrate Judge believes it is important for this Court to take a considered, deliberate, and consistent approach to the application of Cullen. Therefore, although this case is pending on objections before Judge Beckwith, it is hereby ORDERED that Respondent file a memorandum with the Court arguing how the Warden believes Cullen impacts this case not later than April 21, 2011.
