Case Number: 1:09-cv-00099
V.
JEROME J. GROGAN, et al., Defendants.
G Jury Verdict. This action came before the Court for a trial by jury. The issues have been tried and the jury has
rendered its verdict.
G Decision by Court. This action came to trial or hearing before the Court. The issues have been tried or heard and
a decision has been rendered. IT IS ORDERED AND ADJUDGED
...that Plaintiff's complaint must be DISMISSED on the ground that it fails to state a claim upon which relief may be granted under 42 U.S.C. Section 1983 and because it seeks monetary relief from Defendants who are immune from such relief. The complaint is hereby DISMISSED pursuant to 28 U.S.C. Section 1915(e)(2)(B). The Court certifies pursuant to 28 U.S.C. Section 1915(a)(3) that an appeal of this Court's Order would not be taken in good faith and therefore DENIES Plaintiff leave to appeal in forma pauperis. Plaintiff, a non-prisoner, remains free to apply to proceed in forma pauperis in the Court of Appeals.
