IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF OHIO WESTERN DIVISION AT DAYTON
SIDNEY SOUFFRANCE, : Petitioner, : -vsWARDEN, Lebanon Correctional Institution, : Respondent. Case No. 1:09-cv-217 District Judge S. Arthur Spiegel Magistrate Judge Michael R. Merz
ENTRY SETTING FILING DATE FOR REPLY
At the same time as he denied Petitioner's Motion for Transcripts, Magistrate Judge Timothy Black granted Petitioner's request to extend the time for him to file a reply to the Return of Writ, to wit, thirty days from Judge Black's Order or March 17, 2010 (Doc. No. 18). Petitioner did not object to that deadline, but did object to the denial of transcripts (Doc. No. 19). On October 21, 2010, Judge Spiegel sustained Petitioner's Objections and ordered that he be furnished with the transcripts (Doc. No. 23). Respondent's counsel has now certified compliance with that Order on October 25, 2010 (Doc. No. 24). It is therefore appropriate to set a new date for Petitioner's reply which he is ordered to file not later than December 30, 2010. November 30, 2010.
