ORDER
The Court has reviewed the Report and Recommendations of United States Magistrate Judge
Karen L. Litkovitz filed on May 20, 2016 (Doc. 173), to whom this case was referred pursuant to 28
U.S.C. §636(b), and noting that no objections have been filed thereto and that the time for filing
such objections under Fed. R. Civ. P. 72(b) expired June 6, 2016, hereby ADOPTS said Report and
Recommendation.
Accordingly, plaintiffs’ motion for partial dismissal (Doc. 153) is DENIED as moot.
First financial’s motion to dismiss (Doc. 159) is DISMISSED.
The Clerk is directed to note that the following defendants have been terminated from this
action as they are no longer named as defendants in plaintiffs second amended complaint: Larry
Sheakley, Matt Sheakley, Thomas E. Pappas, Jr., Steve Wolf, Bryan Bundy, Maureen Surkamp, Ken
Weber, Susan Fernbach, Kimberly Martin, Heather Fair, and First Financial Bank, N.A.
