OPINION AND ORDER granting 3 Defendant's Motion for Partial Judgment on the Pleadings as to Counts I and II. Plaintiff's FMLA claims are dismissed; denying 5 Plaintiff's Motion to Amend Complaint. Plaintiff may proceed in this Court with her Title VII gender-discrimination claims, for which Congress has shown a clear intent to abrogate Eleventh Amendment immunity.
