IT IS ORDERED AND ADJUDGED ...the Court ADOPTS and AFFIRMS the Magistrate Judge's Report and Recommendation in all respects (doc. 6) Plaintiff's Complaint, which the Court finds to be frivolous, is hereby DIMISSED WITH PREJUDICE and Plaintiff is ADVISED that if he continues to file lawsuits with this Court that are subject to dismissal on screening, he may be subject to sanctions under Fed. R. Civ. P. 11 as a vexatious litigator. We note that Plaintiff was granted leave to proceed in this matter in forma pauperis by the Magistrate Judge 4 . The Court CERTIFIES that any appeal of this Order would not be taken in good faith for the reasons stated in the Magistrate Judges Report and Recommendation; any application made to this Court to appeal in forma pauperis thus will be DENIED. As a non-prisoner, however, pursuant to Fed. R.
