ORDER
United States Probation Officer, Melissa Mutter, was issued a subpoena to appear in
the Juvenile Court of Forsyth County, Georgia on May 5th or 6th, 2014 as a witness in the case of
the minor child(ren) of Megan Ohlinger. Ms. Ohlinger is being supervised by Ms. Mutter in
United States District Court for the Southern District of Ohio in Cincinnati.
According to the federal probation office policy on the handling of state court subpoenas,
“Probation officers conduct their activities for the primary purpose of serving the federal court
and the order of the sentencing Judge and should therefore attempt to avoid being placed in the
position of being called as a witness to testify in a state or local court”.
Therefore, based on the policy of the federal probation office, the Court
QUASHES the subpoena and United States Probation Officer Mutter is not permitted to testify.
IT IS SO ORDERED.
