OPINION AND ORDER conditionally granting in part and denying in part the instant petition for a writ of habeas corpus pursuant to 28 U.S.C. §2254, pursuant to remand of the U.S. Court of Appeals for the 6th Circuit. Petitioner's conviction s on aggravated murder, murder, and attempted murder are VACATED subject to the State of Ohio commencing a re-trial on these charges within 90 days.
