Case No. 2:06-cv-413
JUDGE ALGENON L. MARBLEY Magistrate Judge Abel
ORDER This matter is currently before the Court on witness Jean Basick's Motion to Quash Subpoena. (Doc. 119). In her Motion, Ms. Basick asserts that she is unable to testify and produce records within her control and knowledge as an employee of UMCH pursuant to 45 CFR § 164 and ORC § 5122. Based on representations Plaintiff Hadiya Abdulsalaam's attorney made to this Court, however, Ms. Basick's testimony will not fall under the confidentiality protections covered in 45 CFR § 164 and ORC § 5122. This Court, therefore, DENIES the witness's Motion. IT IS SO ORDERED.
