CASE NO. 2:06-CV-00745
PLAINTIFFS,
v.
JUDGE MARBLEY
MAGISTRATE JUDGE KEMP
OHIO SECRETARY OF STATE
JENNIFER BRUNNER, ET AL.
NOTICE OF DEVELOPMENTS IN THE NORTHERN OHIO DISTRICT COURT IN
REGARD TO PLAINTIFFS' PROPOSED FILING WITH THIS COURT OF THE
TRANSCRIPT OF THE DEPOSITION OF MICHAEL CONNELL
On December 10, 2010, plaintiffs filed a motion to reopen Northern District of Ohio
Miscellaneous Case No. 1:08-mc-105, to enable them to file with this Court their deposition of
Michael Connell taken on November 3, 2008.
On December 27, 2010, the law firm which had represented Michael Connell in that
deposition filed a motion for a 30-day extension of time in which interested parties could respond.
On January 6, 2011, the Northern Ohio District Court granted the requested extension of
time. Responses to plaintiffs’ motion from interested parties are now due on or before January 26,
2011.
In view of these developments, as well as the completion of voting in the 2010 elections and
the expiration of time for filing contests of those elections, plaintiffs withdraw their request for an
emergency hearing upon their motion for reconsideration of the Magistrate Judge’s Opinion and
Order of November 19, 2010.
1
Plaintiffs will file with this court the full transcript of the deposition of Michael Connell to
the full extent and at the earliest time they are permitted to do so by the Northern Ohio District
Court.
Respectfully submitted,
