Merz MARC HOUK, Warden, Respondent. : ORDER TO FILE DIGITIZED RECORD AND EXTENDING DATE FOR FILING MOTION FOR CERTIFICATE OF APPEALABILITY This capital habeas corpus case is before the Court on Petitioner’s Motion to Alter or Amend Order Denying Habeas Relief (Doc. No. 121) and will shortly be pending on Petitioner’s expected motion for certificate of appealability. To facilitate consideration of the case by the Magistrate Judge, District Judge Beckwith, and the Sixth Circuit, it is hereby ORDERED that the state court record previously filed herein in paper format be refiled electronically as required by S.D. Ohio Civ. R. 5.1(c). When the record is filed electronically, the Court’s CM/ECF filing system will affix a unique PageID number to each page of the record, displayed in the upper right-hand corner of the page. All papers filed in the case thereafter, by either party, including the answer and the exhibit index, shall include record references to the PageID number. Prior to filing the state court record, the Warden’s counsel shall ensure that any borders on parts of the record (typically, court reporter transcripts) do not obscure the PageID number when the page is 1 filed. The electronic record shall be filed not later than October 1, 2013. To allow Petitioner’s counsel time to ensure that the motion for certificate of appealability contains PageID record references, the time for filing that motion is extended to and including the tenth day after the electronic record is filed.
