Defendants. : : : : : ORDER Civil Action 2:08-cv-982 Judge Holschuh Magistrate Judge Abel This matter is before the Court pursuant to Plaintiff's "Stipulation to Extend Discovery Cutoff" (Doc. 57). Plaintiffs "hereby stipulate and respectfully request this Honorable Court to continue the personal jurisdiction discovery deadline". They state that they wish to extend the deadline for personal jurisdiction discovery from September 10, 2009 to September 30, 2009, to permit them to complete the Fed. R. Civ. Pro. 30(b)(6) deposition of Defendant The Walt Disney Company ("TWDC"), as such deposition was cancelled due to wildfire. Moreover, they request that Plaintiffs have until September 30, 2009 to voluntarily dismiss their claims against TWDC, and that, if they do not do so, TWDC have until October 14, 2009 to file a renewed motion to dismiss for lack of personal jurisdiction. Defendants do not oppose the motion. For good cause shown, the Motion (Doc. 57) is GRANTED. Plaintiffs shall have until September 30, 2009 to voluntarily dismiss all claims against TWDC if it should conclude that there is no reasonable basis for this Court to assert personal jurisdiction over that defendant. If Plaintiff does not voluntarily dismiss those claims, TWDC shall have until October 14, 2009 to file a renewed motion to dismiss for lack of personal jurisdiction. s/Mark R.
