OPINION AND ORDER granting in part and denying in part 20 Defendants' Motion to Dismiss Plaintiff's Amended Complaint. Counts I through V and VII and IX of the Amended Complaint are dismissed. Count VI and Count VIII are dismissed in pa rt. The Department of State is dismissed as a defendant in this case. Plaintiff's Motion for Sanctions 27 is denied. The Parties' respective motions for summary judgment 8 14 25 are dismissed without prejudice. This case shall be scheduled for a status conference within the next 30 days.
