MEMORANDUM IN SUPPORT OF MOTION Pursuant to the scheduling order of this Court, filed on November 23, 2010 in conjunction with the transfer of this action from the United States District Court For the Northern District of California, plaintiffs' memorandum in opposition to defendant's motion to dismiss is due January 14, 2011. Because of the impending holiday schedule and because of the important issues and complexity that the motion and memorandum in opposition presents, plaintiffs request the Court for an extension of twenty-one days to February 4, 2011 to respond to the motion. Pursuant to S. D. Ohio Civ. R. 7.3, plaintiffs have consulted with James A. Wilson, Trial Attorney for defendant, who has agreed to the extension and this motion is, therefore, unopposed. An agreed form of order to the Court as prescribed by S. D. Ohio Civ. R. 7.4 is attached.
