The

Court

conferred

with

counsel

on

February

13,

2013.

Settlement discussions, which have been complex and which have taken
longer than had been anticipated, continue.

The parties anticipate

that those discussions will be complete by April 15, 2013 and ask that
the current pretrial schedule, see Order, Doc. No. 60, be modified to
permit the parties to fully explore the possibility of settlement.
No later than February 15, 2013, the parties will advise the
Court

whether

they

are

willing

to

withdraw

motions,

without prejudice to renewal should settlement not be reached by April
