Order Cancelling Settlement Week Mediation
On December 17, 2012, counsel for the parties participated in a telephone conference
with the Magistrate Judge and requested that the Settlement Week mediation noticed for
December 13, 2012 at 3:00 p.m. be cancelled. The parties are not yet in a position to
mediate. Dr. Eaton's deposition was taken last week. Plaintiff’s counsel now needs to make
a damages calculation. Plaintiff will make a settlement demand in mid-January, then
counsel will see if the dispute can be resolved. If not, the parties believe that the parties will
be in a position to mediate during the March 2013 Settlement Week. The December 2012
Settlement Week mediation is CANCELLED.
The Clerk of Court is DIRECTED to serve a copy of this Order on counsel and the
Settlement Week Mediator Jerry Eichenberger, , 6099 Franz Rd., Dublin, OH 43217.
