ORDER adopting and affirming the Magistrate Judge's October 23, 2012 Report and Recommendation. In accordance with that Report and Recommendation, Defendants Parks, Hale, Khan and Ayres are dismissed. Defendants Eddy and Gardner, against whom plaintiff Austin states no claim, are also dismissed. Plaintiff Austin's claims may proceed only as against Defendants Kasich and Mohr.
