ORDER
This matter is before the court for consideration of the
report and recommendation of the magistrate judge filed on October
29, 2013. The magistrate judge performed the initial screen of the
complaint required under 28 U.S.C. §§1915(e) and 1915A.
The
magistrate judge recommended that plaintiff’s claims against the
Noble Correctional Institution, a state agency, be dismissed, as
the Institution is immune from suit under the Eleventh Amendment
and is not a “person” subject to suit under 42 U.S.C. §1983.

The report and recommendation specifically advised the parties
that the failure to object to the report and recommendation within
fourteen days “will result in a waiver of the right to de novo
