IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF OHIO EASTERN DIVISION Christine Eberly-Bomlitz, Plaintiff : Wells Fargo Bank, National Association, Civil Action 2:13-cv-00968 : v. : Judge Watson : Magistrate Judge Abel : Defendant : Order On February 3, 2014, counsel for all parties participated in a telephone conference. Defendant does not want to participate in the March 2014 Settlement Week. Wells Fargo Bank explained its decision as follows. It wants a decision on its January 31 motion to dismiss/compel arbitration. Further, on January 31 plaintiff Christine Eberly-Bomlitz filed a motion to amend her complaint to add two credit reporting agencies as defendants. Finally, plaintiff’s settlement demand encompasses substantial consequential damages, and Wells Fargo currently has insufficient information to evaluate its exposure to those alleged damages. Accordingly, this lawsuit will not be noticed for the March 2014 Settlement Week. Status Report Due. Counsel are DIRECTED to call my office (614.719.3370) on or before May 2, 2014 to schedule another telephone conference with me to discuss whether they believe it would be helpful to mediate. If new parties are added, counsel should call me within 14 days of the new defendants’ attorneys entering this lawsuit to schedule a telephone conference with me to discuss modifications to the existing scheduling order in light of the discovery to be taken relating to the claims in the amended complaint and the defenses to those claims. s/Mark R.
