IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF OHIO EASTERN DIVISION Retail Service Systems, Inc., : Plaintiff Carolina Bedding Direct, LLC, et al., Defendants Civil Action 2:13-cv-00994 : v. : Judge Smith : Magistrate Judge Abel : Scheduling Conference Order On August 11, 2014, counsel for the parties and for the Trustee of the estate in the Darren Conrad bankruptcy participated in a telephone conference with the Magistrate Judge to discuss defendants’ request to stay the August 15 hearing on plaintiff’s motion for default judgment. Plaintiff’s counsel will circulate a proposed order regarding documents his client seeks regarding defendants’ operating agreements, financial documents, contracts with distributors, and the like. If matters proceed as the bankruptcy trustee’s attorney believes they may, then, on balance, I tend to favor a stay of short duration. Nonetheless, if after having had an opportunity to consider the trustee’s proposal plaintiff RSS wants to go forward with the August 15 hearing, plaintiff’s counsel should advise opposing counsel and counsel for the bankruptcy trustee and schedule a telephone conference with me. s/Mark R.
