ORDER: On 09/22/16, the Court granted Defendants' Motion to Dismiss holding that Plaintiff's breach of contract claim was barred by claim preclusion. Plaintiff appealed the decision. On 6/6/17, the Sixth Circuit Court of Appeals issued a n order directing the Court to vacate the decision and dismiss Plaintiff's complaint for lack of subject matter jurisdiction.
