OPINION AND ORDER: The Court has reviewed Plaintiff's Amended Complaint 9 and find it restates the allegations set forth in the original complaint and fails to correct the deficiencies identified by the Magistrate Judge in her Report and Recom mendation. The Court therefore adopts 3 the Magistrate Judge's 12/07/16 Report and Recommendation. For the reasons set forth in the Report and Recommendation, Plaintiff's Complaint [1-1] is DISMISSED and Plaintiff's Motion to Amend 6 is denied on grounds of futility.
