Order adopting 2 the Magistrate Judge's 07/28/17 Report and Recommendation. The Defendant's motion for leave to proceed in forma pauperis 1 is denied. Mr. Banks is directed to submit within 30 days the $400.00 filing fee, or the required certified trust fund statement from his prison's cashier demonstrating he lacks the means to pay the filing fee.
