ORDER - This case is before the Court on Defendant's Motion to Confirm an Arbitration Award (Doc. No. 43). Talat Akbar has filed a Response in which he opposes confirmation but provides no evidence in support of his objections and no memorandum of law regarding them. Defendant's reply memorandum in support shall be filed no later than June 5, 2009. On May 4, 2009, the Court granted Defendant's motion to add Ronald Akbar as a party as to the confirmation. The Court notes that there is not as yet any proof of service on Ronald Akbar. Under the Federal Arbitration Act, 9 U.S.C. § 9, it appears that, since Ronald Akbar is not a resident of the district in which the award was made, he must be served by the United States Marshal in one of the ways permitted for service of process under Fed.
