ORDER - To the extent the last sentence of Petitioner's Traverse (Doc. No. 42) constitutes a request for discovery, it is denied. To the extent the last sentence of the Traverse constitutes a request for an evidentiary hearing, it is also denie d. Petitioner's counsel shall notify the Court in writing not later than January 20, 2011, whether they desire an opportunity to brief the case further on the merits.
