This matter came before the Court upon the oral motion of defense counsel for an extension of the preliminary injunction hearing and discovery schedule in this matter. The Court having heard the arguments of counsel in a telephone conference of April 1,2010 and having been fully advised, the Court grants defendants= motion and establishes the following modified schedule. 1 All discovery necessary to be fully prepared for the hearing on plaintiffs=
motion for preliminary injunction, including but not limited to the taking of depositions, must be completed by April 23, 1010, unless counsel for the parties agree to conduct discovery beyond this date.

The parties must deliver their discovery responses and all responsive
documents required to be produced within fifteen calendar days from the date on which they are served with the discovery requests whether by e-mail or other means. 3. The parties are permitted to issue subpoenas for documents and
depositions to non-party witnesses, including but not limited to Brian Klaus, an employee of Johnstone Supply, Inc. Johnstone Supply will make Klaus available for deposition. 4. The hearing on plaintiff motion for preliminary injunction is re-set from April
