ORDER - The parties' Joint Motion to Modify Scheduling 49 is GRANTED. It is ORDERED that: (1) Defendant's Motion to Dismiss Second Amended Complaint 46 is WITHDRAWN, without prejudice to filing a new Motion to Dismiss, rendering moot the current briefing schedule set forth by the Court on December 4, 2012; (2) Plaintiff shall file a Third Amended Complaint within 30 days of the date of the closing of the merger; and (3) Defendant shall file their response, including any Motion to Dismiss the Third Amended Complaint, within 30 days thereafter.
