ORDER
On May 23, 2014, the Court heard oral argument by both sides with respect to four
discovery issues now pending in this matter: (1) whether or not counsel for both sides have
agreed to an extrajudicial resolution of certain discovery disputes, and whether Plaintiffs should
be compelled by this Court to comply with a discovery agreement more fully set forth in a May
22, 2014 letter sent by Defendants’ counsel to the Court; (2) whether Plaintiff Dennis Baglama’s
responses to Defendants’ interrogatories numbers 6 and 8 are sufficient; (3) whether Plaintiff
Dennis Baglama’s deposition should proceed, as scheduled, on May 28, 2014; and (4) whether
other fact witness depositions should proceed, as scheduled, on May 29, 2014.
Having considered this matter, the Court rules as follows:
Counsel for both sides shall work in a cooperative fashion to resolve the first of these
four issues. If agreement on this first issue cannot be reached, the Court will reconvene with
counsel by telephone on Tuesday, May 27, 2014.
Plaintiff Dennis Baglama is ORDERED to provide more complete responses to
Defendants’ interrogatories numbers 6 and 8 by Tuesday, May 27, 2014 at 8:00 p.m. EST.
The Baglama deposition shall occur on or before Friday, June 5, 2014 at an exact date,
time, and location to be determined by counsel for both sides.
The depositions of the other fact witnesses shall proceed as scheduled on May 29, 2014.
The June 30, 2014 discovery deadline, see doc. 32 at PageID 344, is CONFIRMED.
IT IS SO ORDERED.
