ORDER GRANTING (doc. 46 ) Motion to depose Marge Sliemers and Mary Hitt and the deposition schedule set forth in the Court's April 16, 2014 Order (doc. 43 ) is MODIFIED accordingly. ORDER Plaintiff’s deposition was taken in Courtroom 5 on April 29, 2014 beginning at approximately 10:00 a.m. with a private court reporter employed by Defendant. appeared pro se. Plaintiff The Court then met with Plaintiff and counsel for Defendant on three occasions: prior to the commencement of the deposition; and two times thereafter during the deposition. The Court made multiple rulings on the record, as follows: (1) Plaintiff shall answer questions concerning his marriage and divorce; (2) Plaintiff shall use his best efforts to give succinct answers to Defendant’s questions, and if a question calls for a yes or no answer, he shall answer “yes” or “no” or “maybe” first, and then give an explanation; and (3) Plaintiff shall answer all questions concerning his discrimination claim at issue in this lawsuit, but need not answer questions related to retaliation, as that claim is not before the Court at this time. Given the significant time it took for the April 29th deposition (on account of Plaintiff’s lengthy answers), Defendant will have an additional 7 hour period, on a different day, to continue Plaintiff’s deposition. This deposition shall occur in the Dayton Federal Courthouse on a date to be determined by the parties. Additionally, Plaintiff advised the Court on April 29 that he no longer wishes to depose Andrea Hicks and Teresa Burke, and instead wishes to depose Marge Sliemers and Mary Hitt. Accordingly, his motion to depose Marge Sliemers and Mary Hitt (doc. 46) is GRANTED and the deposition schedule set forth in the Court’s April 16, 2014 Order (doc. 43) is MODIFIED accordingly. Plaintiff shall work with Defendant’s counsel in a cooperative fashion to schedule these two depositions prior to the discovery deadline. IT IS SO ORDERED. May 1, 2014 s/ Michael J.
