ORDER STRIKING DEFENDANTS’ COUNTERCLAIMS (DOC. 13)
Defendants’ counterclaims filed on May 15, 2014 (doc. 13) are STRIKEN because
Defendants neither filed a motion for leave to amend their pleading nor sought Plaintiff’s consent
as required by Rule 15(a)(2) and S.D. Ohio Civ. R. 7.3(b). Recognizing that the deadline to file
motions to amend the pleadings has now passed, see doc. 11, the Court, acting in the interest of
justice, affords Defendants until May 21, 2014 in which to file a motion for leave to plead these
counterclaims and solicit consent from opposing counsel.
