Rose ORDER PERMITTING WITHDRAWAL OF COUNSEL FOR DEFENDANTS The Court is in receipt of the Motion to Withdraw submitted by Defense Counsel, with its supporting Affidavit. Defense counsel is moving to withdraw as counsel for the eight Mehta family members (Apurva Jayantilal Mehta, Hema A. Mehta, Atman A. Mehta, Sibir A. Mehta, Hasmukh Jivraj Mehta, Amit H. Mehta, Vasant H. Mehta, and Raj H. Mehta) (collectively “Defendants”). The Court is also in receipt of Defense Counsel’s declaration confirming: (a) Defense counsel’s receipt via hand-delivery from Midmark’s counsel of a summons and 14page Verified Petition for Arbitration; and (b) Defense Counsel’s email communication to the Defendants, sending these items to the email addresses that were used for communication in this matter. Accordingly, for good cause shown and given counsel’s compliance with Doc. No. 45, the Court hereby grants the Motion of Defense Counsel – David Fornshell, Richard Porotsky, and Joseph Greiner all of Dinsmore & Shohl LLP – to withdraw as counsel for Defendants.
