ORDER ADOPTING REPORT AND RECOMMENDATIONS -The Court has reviewed the Report and Recommendations of United States Magistrate Judge Michael R. Merz 11 , to whom this case was referred pursuant to 28 U.S.C. Section 636(b), and noting that no objection s have been filed and that the time for filing such objections under Fed. R. Civ. P. 72(b) expired on June 19, 2015, hereby ADOPTS said Report and Recommendations. It is ORDERED that the Petition be dismissed with prejudice. Petitioner is denied a certificate of appealability and the Court certifies to the Sixth Circuit that any appeal would be objectively frivolous and therefore should not be permitted to proceed in forma pauperis.Motion to Dismiss 6 is terminated.
