DECISON AND ENTRY ADOPTING the Report and Recommendations 3 in full; Plaintiff's claims against the Dayton Police Department, the Dayton Municipal Court, and Magistrate Moorman are DISMISSED with prejudice pursuant to 28 U.S.C. §1915(e)(2 ), Plaintiff's excessive force claim under the Fourth Amendment against Defendants Officers Wombold and Cartte are not dismissed, and the United States Marshal's Office are ORDERED to effect service upon Defendants Wombold and Cartte, under Fed. Ovington (Doc. #3), to whom this case was originally referred pursuant to 28 U.S.C. §636(b), and noting that no objections have been filed thereto and that the time for filing such objections under Fed. R. Civ. P. 72(b) has expired, hereby ADOPTS said Report and Recommendations. Accordingly, it is hereby ORDERED that: 1. The Report and Recommendations docketed on June 24, 2016 (Doc. #3) is ADOPTED in full; 2. Plaintiff’s claims against the Dayton Police Department, the Dayton Municipal Court, and Magistrate Moorman are DISMISSED with prejudice pursuant to 28 U.S.C. §1915(e)(2); 3. Plaintiff’s excessive force claim under the Fourth Amendment against Defendants Officers Wombold and Cartte are not dismissed; and 4.
