OPINION AND ORDER by Judge Ronald A. White : The defendants motion for summary judgment 99 is GRANTED with respect to plaintiffs claims concerning James Crabtree Correctional Center, and his claims against the JCCC defendants are DISMISSED WITHOUT PREJUDICE for failure to exhaust administrative remedies, pursuant to 42 U.S.C. § 1997e(a). Plaintiffs motion for a temporary restraining order concerning MACC defendants 102 and his request for injunctive relief in the amended complaint conc erning the JCCC defendants 74 are DENIED as moot. The defendants motion for summary judgment is DENIED WITHOUT PREJUDICE with respect to their claim that plaintiffs beliefs are not sincerely held. The defendants motion for summary judgment is DENIED WITHOUT PREJUDICE with respect to plaintiffs claim for compensatory damages.All remaining pending motions are DENIED WITHOUT PREJUDICE. 134 135 136 137 (acg, Deputy Clerk)
