OPINION AND ORDER by Judge John E Dowdell Defendants Kevin Warne and James Bohanon's Joint Motion for Judgment on the Pleadings and Brief in Support (Doc. 16) is granted in part and denied in part. Plaintiff's § 1983 claim based upon excessive force (Count II of the Complaint) is dismissed with prejudice. His § 1983 claim based upon an unlawful search and seizure by defendants Warne and Bohanon (Count I of the Complaint) remains. ; granting in part and denying in part 16 Motion for Judgment (Re: 2 Complaint ) (SAS, Chambers)
