D a v i s is i n d e f a u l t o f h i s o b l i g a t i o n s u n d e r t h e p r o m i s s o r y notes. C u r r e n t l y due and o w i n g a r e t h e a m o u n t s o f $ 1 0 9 , 9 1 3 . 7 8 i n c l u d i n g i n t e r e s t plus $26.19 per day, and $63,124.21 including interest plus $13.13 p e r day, from November 1, 2008, until paid. The Pietreks p a i d for foreclosure guarantees i n the amounts o f $475 and $336. The beneficial interest i n this t r u s t deed was a s s i g n e d t o A t l a n t i c R e f i n a n c e , L L C , a n d r e c o r d e d A p r i l 4 , 2 0 0 6 , as D o c u m e n t N o . 2 0 0 6 017146. Atlantic Refinance foreclosed its trust deed o n January 5, 2009, in a non-judicial foreclosure. t h e p a r t i e s and b y p u b l i c a t i o n . T h e r e c o r d shows t h a t all d e f e n d a n t s h a v e b e e n s e r v e d with the amended complaint and w i t h the Pietreks' Answer, Counterclaims, a n d Cross Claims. Further, all parties, including non-appearing parties, have been served with the Pietreks' m o t i o n for summary judgment. D a v i s and Sharon Davis i n favor o f the Oregon Department o f Revenue entered August 9, 2007, as No. 2007-037700. A j u d g m e n t for c h i l d a n d s p o u s a l s u p p o r t a g a i n s t D a v i s a n d i n f a v o r o f p l a i n t i f f Shannon R o z a m i a D a v i s w a s entered o n March 5, 2008.
